  • Personal and non-personal information processed by Dynamic in connection with services we provide to clients (development, hosting, maintenance, analytics, marketing, and related services).

  • Situations where Dynamic acts as a data controller (for Dynamic-owned sites) or as a data processor on behalf of clients (for client-owned sites). See Section 4.

We collect information you provide and information collected automatically.

a. Information You Provide (Personal Information)
May include, without limitation:

  • Name, email address, mailing address, phone number

  • Account credentials (username, password)

  • Billing, payment, and invoicing information (when you purchase services)

  • Information submitted via forms, support requests, surveys, or communications

  • Any content you post to the sites or transmit to us

b. Information Collected Automatically (Non-Personal & Microdata)
Our sites and software, including tools and integrations we deploy, may automatically collect technical and usage information such as:

  • IP address, device identifiers, and device type

  • Browser type and version, operating system, screen resolution

  • Referring/exit pages and URLs, pages visited, time and duration of visits, click and interaction events, error logs, and other event-level telemetry (“microdata”)

4. Data Controller / Data Processor Roles

  • Dynamic-Owned Sites: Dynamic Inc. is the data controller for personal information collected on sites we own and operate.

  • Client-Owned Sites: For websites and applications we develop, host, maintain, or operate on behalf of clients, the client is the data controller and Dynamic Inc. acts as a data processor. In those cases, we process personal information only according to our client’s instructions and applicable contractual terms. Users of client-owned sites should review the client’s privacy policy for the definitive statement of data practices for that site.


5. Sharing and Disclosure

We may share information:

  • With service providers, vendors, and contractors who perform functions on our behalf (hosting, analytics, payments, email delivery, customer support, security, etc.). These parties are authorized to use personal information only as necessary to provide services to us.

  • With clients for data collected on client-owned properties, as required by our service agreements.

  • To comply with legal obligations, court orders, or lawful requests by government authorities.

  • To protect our rights, property, safety, or the rights, property, or safety of others.

  • With your consent or at your direction.

We do not sell, rent, or lease personal information to third parties.

12. Your Rights & Choices

Depending on jurisdiction, you may have rights regarding your personal information, including:

  • Access and obtain a copy of personal information we hold about you

  • Request correction of inaccurate or incomplete personal information

  • Request deletion of personal information (subject to legal exceptions)

  • Object to or restrict certain processing activities

  • Opt out of certain disclosures or sales where applicable (for U.S. residents, see CCPA/CPRA below)

  • Withdraw consent where processing is based on consent

14. Automated Decision-Making and Profiling

We do not use automated decision-making that produces legal or similarly significant effects on individuals without notice and appropriate safeguards. 16. Relationship to Terms & Client Contracts

Your use of our software, services, or client-hosted properties may also be governed by our Terms & Conditions  and by each separate client contracts or service agreements. Those documents may contain additional terms related to data use, ownership, liability, and other matters. In the event of a conflict, contractual terms between Dynamic and a client will govern processing of data on client-owned properties.
